关于“领”字号牌车辆登记和使用须知(中英文) |

各国驻沪领事机构:
为使各国驻沪领事机构(以下简称“领馆”)了解我国机动车登记规定和本市道路交通事故快速处置办法,适当使用“领”字号牌车辆,现将有关事宜告知如下:
一、适当使用“领”字号牌车辆由公安机关交通管理部门车辆管理所颁发的机动车“领”字号牌仅限领馆和领馆人员(不包括名誉领事)的公用、自用车辆使用。
领馆和领馆人员应按规定为其公用或自用车辆登记办理“领”字号牌,并有义务对登记在自己名下的“领”字号牌车辆妥善管理和使用,不应将车辆交给领馆以外人员或机构使用。如拟转让或停止使用,应按规定办理“领”字车辆号牌的相关登记手续。
领馆和领馆人员在使用“领”字号牌车辆时应自觉遵守我国道路交通安全法等有关法律法规、自觉服从交通警察的指挥和管理。严禁酒后驾车。
平时应注意对车辆的安全防范,外出办事应将车辆停放在指定场所,锁好门窗,不要将贵重物品留在车内。
因交通事故或交通违法行为遇交通警察检查时,应主动表明身份并接受交通警察检查,主动出示领事官员(公务人员)证、驾驶证、机动车行驶证。必要时应配合交通警察要求做酒精测试。
领事官员执行职务需要先行离开交通事故或交通违法行为检查现场的,应当向交通警察说明理由并约定另行处理的时间和地点。遇有不出示有效证件、擅自离开现? ⒕芫浜辖煌ň旃ぷ鳌⒁约胺橇旃萑嗽奔菔弧傲臁弊趾排瞥盗镜那榭觯浇凑瘴夜缆方煌ò踩ê拖喙氐姆煞ü娲怼?
二、登记注册领馆或领馆人员为其从境外运进的车辆申请“领”字号牌时,应提供上海海关出具的《中华人民共和国海关监管车辆进(出)境领(销)牌照通知书》和上海出入境检验检疫局出具的《商检单》;如系在境内购买的国产车辆,则应出示市政府外事办公室出具的同意使用“领”字号牌的批复照会。
同时需要出具的证明和凭证还包括:领馆出具的车辆所有人证明为领馆照会或领事官员(公务人员)证、机动车来历凭证(销售发票及翻译件)、市国税局出具的车辆免税凭证、有效交强险凭证,以及填写并盖有领馆馆印或机动车所有人签名的《机动车注册登记/转入申请表》。国产车辆还需出具机动车整车出厂合格证,国产非免检车辆还需提供本市机动车安全技术检验机构出具的检验合格证明。
三、注销登记领馆或领馆人员如拟将其车辆复运出境,应办理“不在境内使用”注销登记。进口车辆凭上海海关出具的《中华人民共和国海关监管车辆进(出)境领(销)牌通知书》、境内购买的国产车辆凭市政府外事办公室出具的销牌答复照会办理“领”字车辆号牌的注销登记手续。
同时需要出具的证明和凭证还包括:领馆出具的车辆所有人证明为领馆照会或领事官员(公务人员)证、《机动车登记证书》、《机动车行驶证》、号牌以及填写并盖有领馆馆印或机动车所有人签名的《机动车停驶/复驶/注销登记申请表》。
四、转让出售(转移登记)领馆或领馆人员如拟在本市相互之间转让、出售自己名下登记的“领”字号牌车辆,进口车辆应凭上海海关批准的文件、境内购买的国产车凭市政府外事办公室出具的同意转让批复照会办理转移登记手续。
如拟转让、出售给领馆以外人员或机构应办理“领”字号牌车辆的转移、换牌登记手续,进口车辆应出示上海海关出具的《车辆解除监管证明书》。
同时需要出具的证明和凭证还包括:领馆出具的原机动车所有人和现机动车所有人证明为领馆照会或领事官员(公务人员)证(如向领馆以外人员和机构转让,由受让人提供相应身份证明和车辆完税证明)、全国统一的二手车交易发票、《机动车登记证书》、《机动车行驶证》、号牌、《机动车转移登记申请表》。
五、转籍(1)领馆和领馆人员如拟将已在外省市登记并使用“使”或“领”字号牌的机动车转入本市使用,进口机动车应凭上海海关出具的《中华人民共和国海关监管车辆进(出)境领(销)牌通知书》、境内购买的国产机动车凭市政府外事办公室出具的同意使用“领”字号牌的批复照会办理转入登记手续。
同时需要出具的证明和凭证还包括:领馆出具的车辆所有人证明为领馆照会或领事官员(公务人员)证、机动车档案、市国税局出具的车辆免税凭证、有效交强险凭证,以及填写并盖有领馆馆印或机动车所有人签名的《机动车注册登记/转入申请表》。
(2)领馆和领馆人员如拟将已在本市登记的“领”字号牌机动车转往外省市使用时,进口机动车凭上海海关出具的《中华人民共和国海关监管车辆进(出)境领(销)牌通知书》、境内购买的国产车凭市政府外事办公室出具的销牌通知办理“领”字牌照转移登记手续。
同时需要出具的证明和凭证还包括:领馆出具的车辆所有人证明为领馆照会或领事官员(公务人员)证、全国统一的二手车交易发票、有效交强险凭证,《机动车登记证书》、《机动车行驶证》、号牌、《机动车转移登记申请表》。
六、报废领馆和领馆人员名下登记的“领”字号牌车辆达到我国机动车强制报废标准时,机动车所有人应当在报废期满前将机动车交售给本市旧机动车回收中心,由旧机动车回收中心将报废机动车的登记证书、号牌、行驶证交本市公安机关交通管理部门车辆管理所注销。当因机动车灭失申请注销登记的,应当向公安机关交通管理部门车辆管理所提交相关证明并交回机动车登记证书、号牌和行驶证。如无法交回号牌、行驶证的,应由领馆书面说明情况,并由公安机关交通管理部门车辆管理所公告作废。
七、强制注销机动车所有人逾期不按规定办理注销登记手续的,公安机关交通管理部门车辆管理所将公告该机动车登记证书、号牌、行驶证作废。
八、安全技术检验使用“领”字号牌车辆从登记之日起应按照下列期限进行安全技术检验:
1、载货汽车和大型、中型非营运载客汽车使用期限不满10年的每年检验一次;超过10年的每6个月检验一次。
2、小型、微型非营运载客汽车使用期限不满6年的每2年检验一次;超过6年的每年检验一次;超过15年的每6个月检验一次。
3、摩托车使用期限不满4年的每2年检验一次;超过4年的每年检验一次。
领馆或领馆人员为其名下的“领”字号牌车辆办理检验时,可凭《机动车行驶证》、有效的车辆交强险凭证前往机动车安全技术检验机构进行检验。
检验合格后,凭领馆出具车辆所有人为领馆的证明照会、机动车所有人的领事官员(公务人员)证、《机动车安全检测报告》、《机动车行驶证》、有效的车辆交强险凭证到车辆管理所申领年度“机动车检验合格标志”。
九、交通事故适用简易处理程序“领”字号牌车辆发生交通事故时,如事故财产损失在3万元以下、当事人对事实及成因无争议的,可适用简易程序处理。在记录交通事故时间、地点、对方当事人姓名和联系方式、机动车号牌、驾驶证号、交强险凭证号、碰撞部位,共同签名后快速撤离事故现场,然后自行协商损害赔偿事宜。当事人对交通事故事实及成因有争议的,应当迅速报警。

Notice for Registration and Use of the“Consulate”License Plate Vehicles
To: foreign consular posts in Shanghai
With a view to enabling the foreign consular posts in Shanghai (hereinafter referred to as the consular posts) to understand our country’s regulations on registration of motor vehicles and measures for quick handling of traffic accidents in Shanghai and use the“consulate”license plate vehicles properly, we hereby inform the relevant matters as follows:
I. Proper Use of“Consulate”License Plate Vehicles
The“consulate”license plates issued for motor vehicles by the vehicle administrative organ of the traffic administering department of the public security bureau are restricted only for the use by the public and personal vehicles of the consular posts and personnel (not including honorary consuls).
The consular posts and personnel ought to register and apply for the“consulate”license plates for their public and personnel vehicles according to the regulations, have the obligation to properly control and use the“consulate”license plate vehicles registered in their names and ought not to let the personnel or organs except the consular posts use their vehicles. In case they intend to transfer or stop using their vehicles, they ought to go through the procedures for registration in connection with the“consulate”license plates according to the regulations.
The consular posts and personnel, while using the“consulate”license plate vehicles, ought to observe our country’s Traffic Safety Law and other relevant laws and regulations conscientiously and follow the direction of the traffic police conscientiously. While applying for the“consulate”license plates for the vehicles transported from abroad, the consular posts or personnel ought to provide the《Notice for Receiving (Canceling) License Plates of Imported (Exported) Vehicles Controlled by the Customs of the People’s Republic of China》issued by the Customs of Shanghai and《Commodity Inspection Sheet》issued by the Shanghai Administration for Entry & Exit Inspection and Quarantine, if purchased in China, they ought to produce the note of reply issued by the Foreign Affairs Office of the Shanghai Municipal Government for approving the use of the“consulate”license plates.
The following certificates are also needed to be provided at the same time: the note issued by the consular post for certifying that the vehicle owner is consular post or consular officer (functionary) identity card, certificate for origin of motor vehicle (sales bill and its translation), vehicle’s tax-free certificate issued by the Shanghai State Tax Bureau, effective traffic compulsory insurance certificate and the filled《Application Form for Motor Vehicle Registration/Shifting》stamped with the official seal of the consular post or signed by the motor vehicle owner. In case of China-made vehicles, manufacturer’s certificate of whole vehicle’s quality has also to be provided. In case of a non-inspection-free vehicle, the certificate of quality issued by the city’s motor vehicle safety and technical inspection organ is needed in addition.
III. Cancellation of Registration
In case the consular posts or personnel intend to re-transport their vehicles out of China, they ought to apply for cancellation of registration of“not using in China”. They ought to go through the procedures for canceling the registration of the“consulate”license plates by providing the《Notice for Receiving (Canceling) License Plates of Imported (Exported) Vehicles Controlled by the Customs of the People’s Republic of China》issued by the Customs of Shanghai in case of imported vehicles or the note of reply for plate canceling issued by the Foreign Affairs Office of the Shanghai Municipal Government in case of China-made vehicles purchased in China.
The following certificates are also needed to be provided at the same time: the note issued by the consular post for certifying that the vehicle owner is consular post or consular officer (functionary) identity card,《Motor Vehicle Registration Certificate》,《Motor Vehicle Driving Certificate》, license plate and the filled《Application Form for Stopping Driving/Re-driving/Canceling Registration of Motor Vehicles》stamped with the official seal of the consular post or signed by the motor vehicle owner.
IV. Transfer/Selling (Registration of Transfer)
In case the consular posts or personnel intend to transfer/sell between them in Shanghai the“consulate”license plate vehicles registered in their names, they ought to go through the procedures for registering the transfer by the documents of approval issued by the Customs of Shanghai in case of imported vehicles or by the note of reply for approving the transfer issued by the Foreign Affairs Office of the Shanghai Municipal Government in case of China-made vehicles purchased in China.
In case of intending to transfer/sell their vehicles to the personnel or organs except the consular posts, they ought to go through the procedures for registering the transfer and plate changing of the“consulate”license plate vehicles, and ought to provide the《Certificate for Lifting Control of Vehicle》in case of imported vehicles.

V. Change of Localities
(1) In case the consular posts and personnel intend to shift the“consulate”license plate vehicles already registered and used in other provinces or municipalities into Shanghai for their own use, they ought to go through the procedures of registering the shifting by the《Notice for Receiving (Canceling) License Plates of Imported (Exported) Vehicles Controlled by the Customs of the People’s Republic of China》issued by the Customs of Shanghai in case of imported vehicles or by the Foreign Affairs Office of the Shanghai Municipal Government in case of domestic-made vehicles purchased in China.
The following certificates are also needed to be provided at the same time: the note issued by the consular post for certifying that the vehicle owner is consular post or consular officer (functionary) identity card, motor vehicle files, vehicle’s tax-free certificate issued by the Shanghai State Tax Bureau, effective traffic compulsory insurance certificate and the filled《Application Form for Registration/Shifting of Motor Vehicle》stamped with the official seal of the consular post or signed by motor vehicle owner.
(2) In case the consular posts and personnel intend to shift the“consulate”license plate vehicles already registered in Shanghai to other provinces or municipalities for their own use, they ought to go through the procedures for registering the shifting by the《Notice for Receiving (Canceling) License Plates of Imported (Exported) Vehicles Controlled by the Customs of the People’s Republic of China》issued by the Customs of Shanghai in case of imported vehicles or by the note of reply for plate canceling issued by the Foreign Affairs Office of the Shanghai Municipal Government in case of domestic-made vehicles purchased in China.
The following certificates are also needed to be provided at the same time: the note issued by the consular post for certifying that the vehicle owner is consular post or consular officer (functionary) identity card, the national uniform second-hand vehicle trade bill, effective traffic compulsory insurance certificate,《Motor Vehicle Driving Certificate》, license plate and《Application Form for Motor Vehicle Shifting》.
VI. Vehicle Scrapping
When the“consulate”license plate vehicles registered in the name of the consular posts and personnel reach our country’s standard for compulsory scrapping of motor vehicles, the motor vehicle owner ought to sell the said motor vehicles to the city’s second-hand motor vehicle collection center before the scrapping time limit expires, the latter will hand over the registration certificate, license plate and driving certificate of the scrapped motor vehicle to the vehicle administrative organ of the traffic administering department of the public security bureau for cancellation.. While applying for canceling the registration of a lost motor vehicle, the consular post or personnel ought to deliver certificate in this regard to the vehicle administrative organ of the traffic administering department of the public security bureau, and give back the motor vehicle registration certificates, license plate and driving certificate. If unable to return the license plate and driving certificate, the consular post ought to make a written explanation and the vehicle administrative organ of the traffic administering department of the public security bureau will declare the invalidation of these documents.
VII. Compulsory Cancellation
In case that a motor vehicle owner fails to go through the procedures for canceling the registration after the time limit is exceeded, the vehicle administrative organ of the traffic administering department of the public security bureau will make an announcement declaring the vehicle’s motor vehicle registration certificate, license plate and driving certificate invalid.
VIII. Safety & Technical Inspection
The vehicles using the“consulate”license plates shall, starting from the date of registration, undergo safety and technical inspection according to the following allotted time:
(1)The freight vehicles, large and medium-sized non-commercial passenger vehicles which have been used for less than ten years are to be inspected once a year; and those which have been used for more than ten years are to be inspected once every six months.
(2) The small and mini-sized non-commercial passenger vehicles which have been used for less than six years are to be inspected once every two years; and those which have been used for more than fifteen years are to be inspected once every six months.
(3)The motorcycles which have been used for more than four years are to be inspected once every two years; and those which have been used for more than four years are to be inspected once a year.
For inspection of the“consulate”license plate vehicles registered in their names, the consular posts or personnel may have their vehicles inspected at the motor vehicle safety & technical inspection organ by《Motor Vehicle Driving Certificate》and effective traffic compulsory insurance certificate.
After the inspection passes, they will receive the《Motor Vehicle’s Mark of Conformity》at the vehicle administrative organ by the note issued by the consular post for certifying that the vehicle owner is consular post, motor vehicle owner’s consular officer (functionary) identity card,《Motor Vehicle Safety & Technical Inspection Report》,《Motor Vehicle Driving Certificate》and effective traffic compulsory insurance certificate.
IX. Application of Simplified Procedure for Quick Handling of Traffic Accident
When a“consulate”license plate vehicle comes across a traffic accident, if the property loss due to the accident amounts to less than 30,000 yuan and the parties concerned have no dispute about the fact and cause of the accident, the simplified procedure may be applied to handle the case. After recording the time and location of the traffic accident, names and contact methods of the opposite parties, numbers of the motor vehicle license plates and driver’s licenses, numbers of the traffic compulsory insurance certificates and the collision positions and making joint signatures, the parties concerned may leave the scene quickly, and will then discuss about the compensation for the damage by themselves. In case the parties concerned have a dispute about the fact and cause of the traffic accident, they ought to report to the police immediately.
